Terms of Use
These Terms of Use ("Terms") govern your access to and use of aBetterFoodApp (the "Service"), operated by aBetterFoodApp ("we", "us", or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years of age to use the Service. By accepting these Terms, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.
2. Account Registration
You must provide a valid email address and create a password to register. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
You may not create an account on behalf of another person without authorisation, or use a false identity. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Free Tier and Paid Subscriptions
The Service offers a free tier with limited features and paid subscription plans ("Plans") as described on the Pricing page.
Paid subscriptions are billed in advance on a monthly or yearly basis through Stripe. By subscribing, you authorise us (via Stripe) to charge your payment method on a recurring basis at the then-current price until you cancel.
Plan features, pricing, and available tiers may change at any time. Where a price change affects your active subscription, we will provide at least 30 days' notice before the change takes effect.
Some plans may be subject to fair use. This means normal personal use is allowed, but we may rate-limit extreme, automated, abusive, or otherwise service-disruptive usage to protect quality and availability for all users.
4. Cancellation
You may cancel your subscription at any time through the Billing section of the Service. Cancellation takes effect at the end of the current billing period. Your account will revert to the free tier at that point and you will retain access to your data.
5. No Refund Policy
All payments are final and non-refundable. We do not provide refunds or credits for partial subscription periods, unused features, or cancellations mid-period.
EU / EEA residents: By subscribing to a digital service that is delivered immediately upon purchase and confirming that performance has begun, you expressly waive your right of withdrawal under the Consumer Rights Directive (2011/83/EU) and any applicable national implementation thereof. You will be informed of this waiver and asked to confirm it at the point of purchase.
Exceptions apply only where required by mandatory applicable law that cannot be contractually waived.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorised access to any part of the Service, its servers, or its databases.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Scrape, crawl, or systematically download data from the Service.
- Use the Service to transmit malware, spam, or any harmful content.
- Resell, sublicense, or commercially exploit the Service or its outputs without our prior written consent.
- Impersonate any person or entity or misrepresent your affiliation.
Violation of these rules may result in immediate suspension or termination of your account without notice and without refund.
7. AI Coach — Important Disclaimer
The AI coach feature provides general nutrition information and suggestions for informational purposes only. It is not a substitute for professional medical, nutritional, or dietary advice. Always consult a qualified healthcare provider before making changes to your diet, training, or health regimen, especially if you have a medical condition.
We do not warrant the accuracy, completeness, or suitability of any coach output. Reliance on coach responses is at your own risk.
8. Intellectual Property
All content, trademarks, software, and other intellectual property comprised in the Service are owned by or licensed to us. You are granted a limited, personal, non-exclusive, non-transferable licence to use the Service for your individual non-commercial purposes in accordance with these Terms.
You retain ownership of all data you input into the Service (food entries, profile data, etc.). By submitting data, you grant us a limited licence to process and store it solely to provide the Service to you.
9. Third-Party Services
The Service integrates with third-party services including Stripe for payment processing and external nutrition databases. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the practices of third-party services.
10. Availability and Modifications
We aim to provide a reliable service but do not guarantee uninterrupted access. We may suspend the Service for maintenance, updates, or circumstances beyond our control. We reserve the right to modify, discontinue, or restrict features at any time. Where a material feature is removed from a paid plan, we will provide reasonable notice and a pro-rated credit or the option to cancel.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.
12. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including loss of data, loss of profits, or personal injury — even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising under or related to these Terms or the Service shall not exceed the greater of (a) the amounts you paid us in the 12 months preceding the event giving rise to the claim, or (b) EUR 100.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by applicable law.
13. Indemnification
You agree to indemnify and hold harmless aBetterFoodApp, its affiliates, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.
14. Termination
We may suspend or terminate your account at any time for breach of these Terms, at our sole discretion, with or without prior notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 8, 11, 12, 13, and 16 survive termination.
You may delete your account at any time via Settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of Belgium, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts of Dendermonde, except where mandatory consumer protection laws in your country of residence provide otherwise.
If you are an EU consumer, you may also submit a complaint to your local consumer protection authority or use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
16. Changes to These Terms
We may update these Terms at any time. Material changes will be communicated by email or notice within the Service at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
